A momentous Supreme Court term, how its decisions align with public opinion, and the possibility of reform
The Supreme Court term that ended in June included momentous and politically charged decisions affecting how federal agencies can interpret the law and whether former presidents have immunity for their official actions. It also coincided with fresh criticism of some justices’ ethics. In response, President Joe Biden recently proposed term limits for Supreme Court justices. In a new Q&A, HKS Professor Maya Sen says she sees the court continuing its drift toward right-leaning decisions and away from popular opinion, further driving calls for reform. “From a political perspective, I would predict that the Trump immunity case is probably the one that will drive discussions about the court’s term and, perhaps most importantly, animate talk of reforming the court,” says Sen, the co-founder of SCOTUSPoll, an ongoing national survey of American’s attitudes on major Supreme Court cases. |
